1. How to Enter: Sweepstakes begins 9:01 A.M. ET on September 3, 2003, and ends at 4:59 P.M. ET on October 31, 2003. There is only one way to enter the Smallville's Biggest Fan Sweepstakes. You may enter online by visiting www.dccomics.com/biggestfan and complete the sweepstakes entry form as prompted. Normal Internet access and usage charges imposed by your on-line service will apply. Entries must be received by 11:59 PM (ET) on October 31, 2003.
2. Selection of Winners: One winner per prize (listed in Rule #3) will be randomly selected on or about November 14, 2003, from among all eligible entries received. Odds of winning will be dependent upon the number of eligible entries received. All prizes will be awarded and winners will be notified by email. Prizes are nontransferable and no substitutions will be allowed, except by the Sponsor who reserves the right to award a prize of equal or greater value if advertised prize is unavailable. Sponsor and its agencies assume no responsibility or liability for damages, losses or injury resulting from acceptance or use of any prize.
3. Prizes and Approximate Retail Values: Grand Prize: (1): A copy of Smallville: The Complete First Season on DVD from Warner Home Video, a sponsor-selected DVD player, and 2 Superman Archive Editions from DC Comics. (Approximate Retail Value: $314.82). First Prizes (50): 1 copy of Smallville: The Complete First Season DVD from Warner Home Video, 1 Smallville DC Comic (approximate retail value: $68.87 per prize). Approximate Retail Value of all Prizes: $3443.50. Prizes consist of only those items specifically listed as part of the prize. One winner per family, email address and/or household.
4. Eligibility: This Sweepstakes is open to legal residents of the United States (excluding residents of New York, Rhode Island, Florida and Puerto Rico) who are 13 years of age or older, as of September 3, 2003. Employees of DC Comics, its advertisers, participating retailers and prize providers, and each of their respective subsidiaries, affiliates, parent companies, distributors, divisions, agencies, and their immediate families (parents, children, siblings, spouse) and members of their same households (whether related or not) are not eligible to participate in this sweepstakes. This offer is void in New York, Rhode Island, Florida and Puerto Rico and wherever prohibited or restricted by national, state, or any other government laws. Subject to all federal, state and local laws.
5. General Rules: No responsibility is assumed by Sponsor for technical, hardware or software malfunctions, telephone failures of any kind, or unavailable network connections, failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this sweepstakes which may limit the ability to participate or by any human error which may occur in the processing of the entries in this sweepstakes. On-line entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right to cancel the promotion if it becomes technically corrupted, and award prizes from eligible entries received prior to cancellation. Sponsor reserves the right to substitute prize of equal or greater value. No cash substitutions or transfer of prizes will be permitted except at the sole discretion of sponsor. Sponsor not responsible for prize utility, quality or otherwise. All Federal, state and local taxes and any other expenses or incidentals not specified herein are the sole responsibility of the winner. Sponsor and its agencies assume no responsibility or liability for damages, losses, or injury resulting form acceptance or use of any prize. Potential winners will be required to execute and return an Affidavit of Eligibility, Liability/Publicity Release within 10 days of attempted notification, or the prize will be forfeited and an alternate winner will be selected. If a potential winner is a minor in his/her state of residence, prize will be awarded in the name of parent or legal guardian, who must execute Eligibility documents on behalf of minor. Return of any prize/prize notification as undeliverable will result in disqualification and alternate selection. Acceptance of prize constitutes permission to the sponsor and its agencies to use the winners' names, hometowns, and/or likenesses for promotional purposes without further compensation, unless prohibited by law. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
