SPONSOR: Warner Bros. Online. "Sponsor and its agents" shall mean Warner Bros. Online, advertising and promotional agencies and their respective officers and agents.
ELIGIBILITY: This Sweepstakes is open to legal U.S. residents (excluding PR) who are 18 years of age or older at the time of entry and who were America Online, Inc. ("AOL") subscribers on or before May 5, 2002. Employees of AOL, Time Warner, Inc., Warner Bros., Warner Bros. Online, Warner Bros. Television, and The WB Network and each of their respective parent companies, affiliates, subsidiaries, divisions, and advertising and promotional agencies and their respective officers and agents and the immediate family members and persons living in the same household of each are not eligible.
HOW TO ENTER: This Sweepstakes begins at 12:00:01 a.m. PST on May 6, 2002, and ends at 5:00 p.m. PST on May 16, 2002. To enter the Sweepstakes, sign on to America Online, go to http://www2.warnerbros.com/friendstv/sweepstakes/index.html, or AOL Keyword "Friends", and enter one name of your own creation that you think the character Rachel, from the television show, "Friends" (the "Show") will name her baby (the "Baby Name") and then enter your first name, e-mail address, gender, birthday and zip code (an "Entry"). Each Entry may not exceed twenty-five (25) characters. Only one Entry per day per household is allowed. If more than one such Entry is submitted within 24 hours, only the first such Entry submitted will be accepted.
Illegible and/or incomplete entries are void. By entering, entrants agree to comply with these official rules including all eligibility requirements. Sponsor and its agents are not responsible for lost, late, or misdirected entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the entries. Proof of entering information at website does not constitute proof of delivery or receipt. Use of computer programs and other automatic means to enter the Sweepstakes is prohibited and may result in the disqualification of the entrant. In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to have been submitted by the account holder. All entries become property of the Sponsor and will not be returned.
WINNER SELECTION AND NOTIFICATION: On or about May 23, 2002, the winners will be selected by Sponsor or its designee, whose decision is final and binding on all matters relating to the Sweepstakes, in a random drawing of all the submissions containing the correct Baby Name that was chosen by the Show's producers. If there are no entries that match the Baby Name selected by the Show's producers, winners will be randomly selected from all of the submissions. Winners will be notified by e-mail ("Prize Notification") and must respond by email within 10 days of the date of the Prize Notification (the "Deadline"), with his/her full name and a mailing address where Sponsor can send an Affidavit of Eligibility and Release of Liability (the "Release"). If the winner does not respond to the Prize Notification by the Deadline, the winner will be disqualified and an alternate winner will be selected. Once Sponsor receives the winner's Mailing Information, a Release will be sent to the winner via overnight mail. The winner must sign and return the Release in the pre-paid overnight envelope provided, within 14 days of the date of the Release, or the Prize will be forfeited and an alternate winner selected. Return of any Prize Notification or Release as undeliverable will result in disqualification, and an alternate winner will be selected.
PRIZE AND ODDS OF WINNING:
Grand Prize: One grand prize winner ("Grand Prize Winner") will receive a trip for two (2) to Los Angeles, including round-trip coach air transportation for two (2) from the major airport nearest the Grand Prize Winner's residence, ground transportation for the winner and his/her traveling companion ("Guest") between airport, hotel and Warner Bros. Studios, 3 days/2 nights (single room/double occupancy) hotel accommodations at a hotel selected by Sponsor, two tickets to see a live taping of the Show, a VIP Studio tour and an autographed copy of Friends: The Complete First Season on DVD. Approximate retail value ("ARV") is Two Thousand Six Hundred Dollars ($2,600.00) (the "Grand Prize");
Second Prize: One second prize winner will receive a DVD Player and the Best of Friends and new release of Friends: The Complete First Season DVD Collection. (ARV: $450.00);
Third Prize: One third prize winner will receive a Best of Friends and new release of Friends: The Complete First Season DVD Collection. (ARV: $100.00), ( collectively the "Prize"), (Total ARV $3,150.00)
Sponsor may choose which taping the Grand Prize Winner will attend at its sole discretion, subject to availability and production exigencies. If due to cancellation of the Show or for other reasons, the Grand Prize Winner does not receive the live taping portion of the Grand Prize, then the remaining elements of the Grand Prize shall constitute full satisfaction of Sponsor's Grand Prize obligation to the Grand Prize Winner and no other additional compensation will be awarded. The trip must be taken on dates selected by Sponsor and is dependent upon the Show's production schedule. No Prize substitution will be allowed, except at Sponsor's sole discretion. Prize is non-transferable. Grand Prize Winner and Guest must travel together. Expenses such as ground transportation between the Grand Prize Winner's residence and airport, phone calls, purchases, airport surcharges, departure taxes, and all other expenses not specifically listed are not included. Guest must be18 years of age or older and must sign and return a Liability and Publicity Release which must be received by Sponsor at least 30 days prior to travel, or Guest will not be able to accompany the Grand Prize Winner on the trip. All federal, state, and local taxes related to the Grand Prize are the Grand Prize Winner's sole responsibility. Grand Prize Winner will be issued a 1099 tax form for the total ARV of the Grand Prize. Odds of winning depend on the number of eligible entries received.
GENERAL CONDITIONS: This Sweepstakes is governed by the laws of the State of California, with venue in Los Angeles County, California, and all claims must be resolved in the state or federal courts of Los Angeles County, California. By entering, entrants agree: (a) to be bound by the Official Rules, the decisions of the judge, and the Warner Bros. Online Privacy Policy (b) to release and hold harmless Sponsor from any and all claims, demands, damages, losses or liabilities caused by, arising out of, or related to their participation in the Sweepstakes and/or their participation in any Prize-related activities; and (c) to be contacted by Sponsor via e-mail. By accepting the Prize, winners consent to the use of his/her name, voice and/or likeness for advertising and promotional purposes without additional compensation (except if a winner is a resident of TN or where prohibited by law).
INTERNET: If for any reason the Sweepstakes is not capable of running as planned, including infection due to computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the Sweepstakes and to select the winners from all eligible entries received prior to the cancellation or termination. Sponsor is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or Entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation in the Sweepstakes.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
