The following are the terms and conditions for submitting a photo for consideration by Riverside Productions, Inc. ("Producer") on Blue Collar TV ("Series"):
1. I, the photographer of this photograph ("Photographer"), have voluntarily agreed to submit this photograph for possible use in the Series. Producer agrees to receive this submission and include it among the submissions which may be reviewed in connection with producing the Series. But I understand and agree that Producer won\'t be able to review all submissions, and that Producer has no obligation to review or use the photograph. If Producer does choose to use the photograph, I will not receive any compensation for such use. I am submitting the photograph solely for the possible enjoyment of seeing it on television.
2. I understand and acknowledge that the Series is a sketch comedy show and that the comedy in which the photograph may appear (and the comments made about the photograph) may be surprising, humiliating, embarrassing, derogatory, and/or otherwise offensive.
3. I understand that neither Producer nor any person associated with the Series will review or consider any photograph that has any people in it unless each person appearing in the photograph has read this release and agreed to its terms.
(a) If I use this website to submit a photograph containing people and the photograph is selected for possible use in the Series, I understand that Producer will contact me and require me to obtain signed copies of the accompanying Appearance Release from each person appearing in the photograph along with a proof of each person\'s identity (e.g., driver\'s license, passport, etc.). If no people appear in the photograph, only the terms of this release must be accepted.
(b) If I use the mail to submit a photograph containing people, every person appearing in the photograph must personally fill in all of the information in the accompanying Appearance Release and submit proof of his/her identity (e.g., driver\'s license, passport, etc) along with the photograph. If no people appear in the photograph, only I must sign below in the space indicated "PHOTOGRAPHER" and no other signatures or releases are required.
(c) I understand that every person in the photograph must be at least 18 years of age or the photograph will not be considered for possible use in the Series
4. I represent and warrant that (i) I personally took the photograph, (ii) it is a picture of my backyard or the owner of the yard has signed the Yard Release Form, (iii) I have not sold or transferred the rights to the photograph to anyone else, and (iv) I am not a professional photographer.
5. I hereby assign to Producer all rights in the photograph, including but not limited to the perpetual right to use it in the Series or otherwise in all media now or hereafter known throughout the world. I also understand and agree that Producer may alter the photograph as it sees fit and combine the photograph with other material and/or comment on such photograph in any manner in which Producer sees fit.
6. I hereby release and forever discharge Producer, any program sponsor and advertiser, all distributors, all networks and stations televising any program containing the photograph or portions thereof, and their respective affiliated companies, officers, agents, licensees, partners, employees and assigns (hereinafter "Released Parties") from all claims, demands and actions of every kind and nature, whether or not now known or suspected, which I, my heirs, executors, administrators, legal successors or assigns now have or may have against the Released Parties arising out of or in any way connected with the photograph or the Series.
7. Any dispute of any kind between the Parties arising under this Release Agreement or use of the photograph shall be resolved by binding arbitration in Los Angeles, California, pursuant to California Code of Civil Procedure Section 1280 et seq., except that limited discovery may be conducted by the Parties as permitted by the arbitrator. The arbitrator shall be selected by mutual agreement of the Parties but shall be a person with substantial experience in the entertainment industry. The arbitrator\'s decision shall be final and binding. The Parties waive their rights to appeal any aspect of any judgment entered pursuant to California Code of Civil Procedure Section 1287.4 as a result of said decision. I agree that if all or part of the photograph is used in the Series, I will NOT be entitled to an injunction stopping that use.
8. I understand that Producer may license or assign any of its rights in the photograph to other parties and that those parties will have the benefits of this agreement.
I REPRESENT AND WARRANT THAT I HAVE READ ALL OF THE CONDITIONS AND TERMS SET FORTH ABOVE AND FULLY UNDERSTAND EACH TERM AND CONDITION. I AGREE TO EACH TERM AND CONDITION AND ACKNOWLEDGE AND UNDERSTAND THAT THE SUBMISSION OF THE PHOTOGRAPH VIA THIS WEBSITE OR OTHERWISE IRREVOCABLY BINDS ME TO ALL OF THE ABOVE CONDITIONS AND TERMS.'); }
